These Terms of Service ("Terms") govern your access to and use of Shootbin's photo proofing platform and services. By creating an account or using Shootbin, you agree to be bound by these Terms.
By accessing or using Shootbin, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services. You must be at least 16 years old to use Shootbin.
Shootbin is a cloud-based photo proofing platform that allows photographers to upload images, create albums, invite clients or reviewers to review photos, collect feedback, and manage the approval workflow. We provide the infrastructure, storage, and tools necessary for you to conduct photo proofing with your clients.
We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice.

Shootbin offers both free and paid subscription plans. By subscribing to a paid plan, you agree to:
Subscriptions automatically renew unless cancelled before the end of the billing period. You may cancel your subscription at any time through your account settings. Your access to paid features will continue until the end of your current billing period.
"Your Content" refers to any photos, images, albums, text, feedback, or other materials you upload or submit through Shootbin. You retain all ownership rights to Your Content.
By uploading Your Content to Shootbin, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing our services to you. We do not claim any ownership rights over Your Content.

Within Shootbin, you can archive projects and their associated files to easily reuse them later. For some accounts, this archive is unlimited, giving you the flexibility to work without worrying about fixed storage limits.
We do expect this feature to be used as intended, as part of your workflow as a photographer or agency. The archive is not intended to function as a general-purpose storage or backup service unrelated to active or completed projects within Shootbin.
To maintain the quality and performance of the platform for everyone, we apply a fair use policy. This means that in exceptional cases, we may take action if usage clearly falls outside the normal use of Shootbin.

We will always assess this reasonably and with common sense, taking into account how the archive is used and how it aligns with Shootbin’s intended purpose. In practice, this will only apply to exceptional cases, and most users will never notice any impact.
Shootbin allows you to invite clients, collaborators, and reviewers to view and review your photos. When you share Your Content with others, you are responsible for:

Shootbin provides a platform for photographers to share photos with clients, collaborators, and reviewers. Any contractual agreements, work orders, or other legal arrangements between the photographer and their clients are governed solely by the terms of those separate agreements.
When a client, collaborator, or approver signs or agrees to a contract provided by the photographer through Shootbin's contract feature or any other means, they are legally bound by the terms of that agreement. This includes, but is not limited to:
Shootbin is not a party to any such contracts and assumes no liability for the terms, enforceability, or fulfillment of agreements made between photographers and their clients. Users are solely responsible for ensuring their contracts are legally valid and enforceable in their respective jurisdictions.
The Shootbin platform, including its design, features, functionality, and all related software, are owned by Shootbin and protected by intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of Shootbin without our prior written consent. You may not reverse engineer or attempt to extract the source code of our software.
All trademarks, logos, and service marks displayed on Shootbin are the property of their respective owners.
We store Your Content on our servers to provide you with our services. You may delete Your Content at any time through the platform. Upon account deletion, we will initiate the removal process as described in our Privacy Policy.
Inactive Hobby accounts may be removed under the retention process in our Privacy Policy. We send a reminder after approximately 90 days of inactivity and a warning with a specific deletion date after approximately 120 days. If you do not sign in again, the account and its Content may be deleted 14 days after that warning. Signing in cancels the scheduled deletion.
We are not responsible for retaining backup copies of Your Content after deletion. We recommend that you maintain your own backups of important content.
SHOOTBIN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
You use Shootbin at your own risk. We are not responsible for any loss of data, business interruption, or other damages resulting from your use of our services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOOTBIN AND ITS FOUNDERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF SHOOTBIN SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Shootbin and its founders, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

You may terminate your Shootbin account at any time through your account settings. We may suspend or terminate your access to Shootbin:

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Shootbin shall be subject to the exclusive jurisdiction of the courts of Belgium.
